Terms of Service — Exquisite Caskets

Welcome to Exquisite Caskets. These Terms of Service (“Terms”) govern your access to and use of exquisitecaskets.com (the “Site”), and any purchases made through the Site. By accessing the Site or placing an order, you agree to these Terms.

If you do not agree, do not use the Site.

1) Definitions

For clarity, the following terms have the meanings below: “Exquisite Caskets,” “we,” “us,” “our” means Exquisite Caskets and its owners, affiliates, and representatives. “You,” “your” means any visitor, customer, or user of the Site. “Products” means caskets and any related items offered for sale on the Site. “Order" means a request to purchase Products submitted through the Site. “Receiving Facility” means any funeral home, church, residence, cemetery, or other location designated to receive delivery.2) Who We Are

Exquisite Caskets is an online retailer of funeral merchandise, including caskets and related Products.

Important: We are not a funeral home and do not provide funeral services. Funeral homes, cemeteries, crematories, and other providers may have requirements that affect your arrangements.

3) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the most recent version. Your continued use of the Site after changes means you accept the updated Terms.

4) Privacy

Your use of the Site is also subject to our Privacy Policy (if/when posted). If posted, it is incorporated by reference into these Terms.

5) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site and place Orders.

6) Product Information, Availability, and Pricing

We work to display Product descriptions, images, features, and pricing accurately. However: Product appearance (including color) can vary by screen/device and lighting. We may correct errors or omissions (including pricing, descriptions, promotions, or availability) at any time. Products may be limited, discontinued, or unavailable without notice. If a Product is listed at an incorrect price due to an error, we may cancel the Order and refund any amount charged.

7) Orders7.1 Order Acceptance

Submitting an Order is an offer to purchase. We may accept, reject, limit, or cancel Orders in our discretion, including for reasons such as: 1.Product availability 2.Address or delivery constraints 3.Verification needs 4.Suspected fraud or unauthorized payment activity 5.Errors in listing information

If we cancel an Order after payment is authorized or captured, we will issue a refund to the original payment method (subject to payment provider timelines).

7.2 Accurate Information & Coordination

For time-sensitive deliveries, accurate details matter. You are responsible for providing correct: 1.Recipient name and delivery location 2.Contact phone number/email 3.Receiving Facility receiving instructions/hours (if applicable) 4.Any service date or timing considerations

We may contact you (and/or the Receiving Facility) to confirm delivery details.

7.3 Right to Refuse Service

We may refuse service, cancel Orders, or limit quantities where permitted by law.

8) Payment Methods, Authorization, and Taxes

8.1 Payment Methods

At checkout, we currently accept (availability may vary by device/browser and provider rules): 1.PayPal 2.Venmo (via PayPal) 3.PayPal Pay Later (Buy Now, Pay Later, when eligible)

Credit/Debit Cards:

Visa, Mastercard, American Express, Discover, JCB, Diners Club, UnionPay

Google Pay (when available)

8.2 Authorization

By submitting payment information, you represent you are authorized to use the selected payment method and authorize us (and our payment processors) to charge the total amount of your Order, including applicable taxes and any optional fees you select.

8.3 Taxes

Prices may not include applicable sales/use taxes unless stated. You agree to pay all taxes that apply to your Order.

8.4 Chargebacks

If you initiate a chargeback or payment dispute, we may provide order details, delivery confirmation, and related documentation to the payment provider. We also reserve the right to suspend future purchases associated with the account, payment method, or contact information involved.

9) Shipping, Delivery, and Timing

9.1 Estimated Delivery Window

Most Orders arrive in 2–5 business days, depending on destination and carrier scheduling. Delivery timelines are estimates, not guarantees, and can be affected by carrier capacity, weather, regional disruptions, Receiving Facility scheduling, and other factors beyond our control.

9.2 Processing Cut-Off

Orders placed after 2:00 PM Eastern Time(ET) begin processing the next business day. Orders placed on Saturday or Sunday

begin processing on Monday (the first business day).

9.3 Delivery Location

We commonly ship to funeral homes and can often ship to other eligible locations. Some locations require appointments, access confirmation, or additional coordination. You are responsible for ensuring the Receiving Facility can accept delivery.

9.4 Failed Delivery / Incorrect Address

If delivery fails due to incorrect address information, lack of access, refusal to accept delivery (other than verified damage), or inability to schedule with the Receiving Facility, the Order may be treated as a return/cancellation and freight-related costs may apply.

9.5 Risk of Loss

Risk of loss transfers upon delivery to the address provided or acceptance by the Receiving Facility, except where prohibited by law.

10) The FTC Funeral Rule and Funeral Home Acceptance

Federal rules protect your right to purchase a casket from the provider of your choice. Funeral providers generally cannot refuse to handle a casket you purchased elsewhere or charge a fee solely because it was purchased from a third party. If a funeral home has questions about receiving delivery, ask them to contact us and we will coordinate.

11) Damage, Defects, and Delivery Issues

Because freight handling can be involved, inspect at delivery when possible. If there is visible damage, you should refuse delivery

when feasible and document the issue with photos.

12) Returns, Refunds, and Cancellations

12.1 Returns (10 Days)

You may request a return within 10 days of delivery if the Product:

Is unused and in new/resalable condition, and Is in the original packaging/crate required for freight return. Returns require prior authorization and return instructions from Exquisite Caskets.

12.2 Return Shipping & Fees

Unless the return is due to our error or verified damage/defect, return shipping costs are your responsibility, and a restocking fee may apply based on handling and condition.

12.3 Cancellations

If your Order has not shipped, cancellation is typically straightforward. Once an Order is in transit, cancellation may be treated as a return and freight-related costs may apply (For full details, see our Return Policy page.)

13) Promotions, Coupons, and Discounts

Promotions may have separate terms, expiration dates, and eligibility rules. We may modify or end promotions at any time unless prohibited by law.

14) Intellectual Property

The Site and all content on it—text, graphics, logos, product images, layout, and design—are owned by Exquisite Caskets or licensed to us and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission.

15) DMCA Notice & Takedown Policy (Copyright)

Exquisite Caskets respects the intellectual property rights of others and expects the same from our users and visitors. If you believe content on the Site infringes your copyright, you may submit a notice under the U.S. Digital Millennium Copyright Act (“DMCA”). Upon receiving a valid notice, we will review it and, when appropriate, remove or disable access to the content.

15.1 How to Submit a DMCA Notice

To help us process your request promptly, your notice must include all of the following: A physical or electronic signature of the copyright owner (or a person authorized to act on the owner’s behalf). Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works). Identification of the material you claim is infringing, and information reasonably sufficient to allow us to locate it on the Site (such as the specific page URL(s)). Your contact information, including your name, mailing address, telephone number, and email address. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law. A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

Please write “DMCA Notice” in the subject line (email) or on the envelope (mail) to help us route your request quickly.

15.3 Counter-Notification (If You Believe Content Was Removed by Mistake)

If you believe your content was removed or disabled due to mistake or misidentification, you may submit a counter-notification. Your counter-notice must include:

Your physical or electronic signature. Identification of the material that was removed/disabled and the location where it appeared before removal (such as the page URL(s)). A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the District of Delaware (and that you will accept service of process from the person who submitted the original DMCA notice or their agent). Send counter-notifications to the same contact information listed above.

15.4 Repeat Infringers

Where appropriate and in accordance with the DMCA, Exquisite Caskets may, in our discretion, terminate access to the Site for users who are determined to be repeat infringers.

15.5 Important Note

This DMCA process applies to copyright issues (for example, photos, written content, artwork, videos). If your concern relates to trademarks (brand names/logos) or other rights, please contact us at info@exquisitecaskets.com so we can route your request appropriately.

16) Prohibited Uses

You agree not to:

1. Use the Site for unlawful purposes 2.Interfere with Site security or functionality 3. Attempt unauthorized access to systems or data 4.Misrepresent identity or payment authorization 5.Use automated scraping tools without permission 6.Post or transmit harmful code (viruses, malware, etc.). We may suspend or block access for violations.

17) Third-Party Services and Links

The Site may reference third-party services (including payment processors) or link to third-party websites. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their terms.

18) Electronic Communications

By using the Site or placing an Order, you consent to receive communications from us electronically (including email) and by phone/text when related to your Order, delivery coordination, customer support, or legal notices. Standard message/data rates may apply.

19) Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation of the Site.

20) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXQUISITE CASKETS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM (OR $100 IF NO PURCHASE WAS MADE), UNLESS A DIFFERENT LIMITATION IS REQUIRED BY LAW. Some jurisdictions do not allow certain limitations—so some of the above may not apply to you.

21) Indemnification

You agree to indemnify and hold harmless Exquisite Caskets and its owners, officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of any rights of another.

22) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including severe weather, natural disasters, carrier disruptions, labor disputes, governmental actions, power/Internet outages, or other force majeure events.

23) Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. If a dispute is not subject to arbitration (as described in Section 24), you agree that it will be brought exclusively in the state or federal courts located in Kent County, Delaware, and you consent to personal jurisdiction and venue in those courts.

24) Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES MOST DISPUTES TO BE RESOLVED BY ARBITRATION INSTEAD OF IN COURT.

24.1 Agreement to Arbitrate; Federal Arbitration Act

You and Exquisite Caskets agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, your use of the Site, or any Order/Product (collectively, “Disputes”) will be resolved by binding individual arbitration, not in court. This agreement to arbitrate is governed by the Federal Arbitration Act (9 U.S.C. §§ 1–16) and is intended to be broadly interpreted.

24.2 Informal Resolution First

Before starting arbitration, you agree to contact us and attempt to resolve the Dispute informally.

Include your name, order number (if applicable), a description of the issue, and the relief you’re requesting. We’ll work in good faith to resolve the matter. If we can’t resolve it within 30 days of receiving your notice, either party may proceed to arbitration.

24.3 Exceptions

Either party may bring an individual claim in small claims court if it qualifies and remains in small claims court. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to prevent unlawful use of intellectual property or violation of Section 14 (Intellectual Property).

24.4 Arbitration Administrator and Rules

The arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable rules, including the AAA Consumer Arbitration Rules, unless the parties agree otherwise. The arbitrator has authority to decide all issues of arbitrability to the fullest extent permitted by law.

24.5 Location and Format

The arbitration will take place in Kent County, Delaware, unless you and we agree otherwise or the arbitrator determines a different format/location is appropriate under the applicable rules. Arbitration may be conducted in person, by video, by telephone, or through written submissions, as determined by the arbitrator and permitted by the rules.

24.6 Fees and Costs

Payment of arbitration fees will be governed by AAA rules and applicable law. Each party will bear its own attorneys’ fees and costs unless the arbitrator awards fees under applicable law.

24.7 Class Action Waiver

You and Exquisite Caskets agree that Disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.

24.8 Jury Trial Waiver

If for any reason a Dispute proceeds in court rather than arbitration, you and Exquisite Caskets each waive any right to a jury trial.

24.9 Severability

If any portion of this Section 24 is found unenforceable, the unenforceable portion will be severed and the remainder will be enforced to the fullest extent permitted by law—except that if the Class Action Waiver in Section 24.7 is found unenforceable, then this entire Section 24 will be null and void.

25) Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

26) Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

27) Entire Agreement

These Terms, together with any policies posted on the Site (including the Return Policy and any Privacy Policy), form the entire agreement between you and Exquisite Caskets regarding the Site and purchases.
